Chapter 13 Bankruptcy
With Chapter 13 bankruptcy there is an expectation that, if given time, you can pay off the debts that are attached to your name. When experiencing Chapter 13 you are given the opportunity to restructure or re-organize your debt.
Before you can apply for Chapter 13 bankruptcy you first must qualify for it. You will need to have:
- Regular income
- Unsecured debts of less than $419,275
- Secured debts of less than $1,257,850 (this amount is usually increased every three years according to a set formula).
With Chapter 13, while it will remain on your credit report for seven years just like Chapter 7, you are actually paying off your debts yourself, but in a structured format. All bills and debts are consolidated into a singular bill. You will need to make payments on time over a set period of time. If you fail to make these payments then your trustee can request to the court to have your case dismissed which will lead to none of your debts being paid off.
