Having Back Tax Problems Gets Old!

Once you owe the IRS or the State of Hawaii, they become very aggressive in their attempts to collect. Some of the most common methods of collection include bank levies, garnishing wages and even seizing your personal assets like homes and cars for sale at auctions. The tax collectors do not care – they just want to get paid, and they don’t care who pays your taxes. Although bankruptcy is often times your most workable option to eliminate back tax problems, it is not always the best choice. Therefore, our Honolulu bankruptcy lawyer offers other solutions to deal with the IRS and State that could help you avoid bankruptcy.

Offer In Compromise (OIC)

The IRS allows you to negotiate with them to repay old tax debts. It is their way of cleaning up an existing mess and encouraging you to get back into the system. The Offer In Compromise program is based on supplying the IRS or the State with financial information that will show them you’re entitled to a break on repayment of the whole liability.

We can work with you through this process to see what you qualify for based on a few factors that the IRS looks into.

Ability to pay

The IRS will first look into seeing if you even have the ability to pay them back. Do you have a job? Are you unemployed and if so what are prospects for re-employment at the moment?

Income

What is your income? The IRS will want to know how much money you are bringing into your home before they can come to a conclusion on what you’re eligible for. Your income and living situation could impact if you qualify for OIC.

Expenses

Are you making minimum wage but have the expenses of someone on a $50,000 salary? The IRS will want to know this.

Asset equity

What are your current assets worth?  

We can help you decide if you qualify for this or if you have better options elsewhere. The IRS will generally approve OIC cases if there’s reason to believe that most of it can be paid off in a reasonable amount of time. Depending on how bad your net worth and current income looks, you could be entitled to a “pennies on the dollar” settlement.

Penalty Abatement

Tax problems will continue to get worse and more expensive with new penalties and interest added each day. You may qualify for Penalty Abatement however if you were attempting to follow the requirements of tax law and couldn’t meet them due to situations out of your control. If your reason is justified for failing to file your return, pay your taxes on time, or forget to do any myriad of tax compliance steps, we may be able to negotiate an abatement of your tax penalties and the interest associated with them.

There are many grounds the IRS and the State typically consider “reasonable cause” for avoiding the assessment of a penalty. Fill out our questionnaire and we can see if your case qualifies. If you do then we maY work with you to try and give you a smoother Penalty Abatement process.

Once we’ve worked through this we can help you submit your case to the IRS. They will review the facts and effort you made as well as prior history in filing your taxes on time.

Innocent/Injured Spouse Relief

If you were unaware of a spouse’s failure to be forthright on your joint tax return, then the taxing entities allow a simple approach to relieve you from the responsibility of shouldering your half of the tax burden. This process requires certain forms that are available from the IRS and the State of Hawaii.

We can help you find those forms and show you how to properly fill them out. This can obviously be a complicated and stressful process, but we can help you get through them to the best of our ability. We want to help you to the best of our ability and we can do that by knowing your situation. So come in prepared and we may be open to giving you the best support we possibly can.

Installment Agreements

If your situation just falls outside the parameters of the Offer In Compromise, Penalty Abatement, or Innocent/Injured Spouse programs, then the IRS and the State will still accept a repayment of your tax liabilities on an installment basis, if we can convince them that that’s the most effective and efficient way of collecting the tax. Depending on your situation that may be what we seek out, but this is typically a case by case basis.

Higher tax liabilities can often require significant negotiating to prevent a levy or seizure from taking place – installment agreements relating to taxes under a certain dollar amount are usually easier.

If we are able to secure you a payment plan that the IRS agrees to then we can move into what kind of payment plan you are participating in.

Short Term payment plan

A short term payment plan is an agreement with the IRS that you will be paying your taxes owed within a certain period of time. If the IRS agrees to this then you may not be liable for a user fee.

Payment plans costs and fees

While we can try to avoid you paying payment plans costs and fees, there may be cases where the IRS will add a tax bill to your status despite our best abilities to avoid this situation. We will work with you throughout this process.

Releasing Tax Liens and Levies

As a preliminary step in using an Offer In Compromise, Installment Agreement, or other program, we often need to act quickly in order to delay, avoid, or release their powerful lien and levy capabilities. This can often be accomplished if we can explain that our offer to them is the most effective and unobtrusive form of satisfying the tax liability.

After this the IRS may choose one of the following options based on your situation.

Discharge of property

A discharge will remove the lien from the property itself. If this option is available we may try to pursue it.

Subordination

The subordination option does not remove the lien from your case, but will allow other creditors to move ahead of the IRS and finding a loan or mortgage becomes a more realistic option.

Withdrawal

When a withdrawal occurs the IRS will not compete with other creditors for your property, but the amount due still must be paid in full.

Born and raised on the island of Oahu, Malia Connor moved to California’s Bay Area to study dance at San Francisco State University, where she formed her own dance company, 25 years ago. She moved back to Oahu in 2017 to begin taking care of her aging parents.

Anna Lisa Hughes

Anna Lisa Hughes received a Bachelor’s degree in Spanish from San Francisco State University, and became fluent in both Spanish and Mandarin Chinese while studying and working abroad in Chile and China. Anna Lisa has nine years of paralegal experience in various areas of practice, including immigration, estate planning, civil rights, and bankruptcy law. Originally from Colorado, she moved to Hawaii for the cultural and ethnic diversity of the island of Oahu. Outside of the office, Anna Lisa has also had a career in music as a bassist and songwriter.

Joshua Humpries

Joshua Humphries is a 2008 graduate from the Widener University School of Law in Delaware. Upon graduation, he worked for a national law firm specializing in Chapter 7 and Chapter 13 bankruptcies for several years before moving to a smaller firm where he continued he established the firm’s bankruptcy practice. During that time, he also represented claimants in workers compensation and social security disability claims. In 2013, he also began practicing in the areas of debt collection and general civil litigation. He is licensed in Pennsylvania, New Jersey, Hawaii and admitted to the Federal Courts for the District of New Jersey, Eastern and Middle Districts of Pennsylvania and the District of Hawaii.

Dora Casillas

Prior to coming to this beautiful island, Dora Casillas lived in Simi Valley, California where she worked in the legal field for 18 years. Dora finds bankruptcy law the most rewarding where at the end of the day, she knows she helped many obtain a fresh start leading to a less stressful life.

Julia Oaten

I attended the University of Manchester, (UK) gaining a B.A. with Honors in Art History, before obtaining my J.D. from the University of Baltimore School of Law. Before moving to Hawaii and specializing in bankruptcy, I practiced criminal law as a Public Defender in Annapolis, MD.

While I am Cuban – Armenian, I grew up in England. My family and I moved to Hawaii in 2007 when my husband was offered a great job here. I stayed at home until we were all settled in and then responded to Blake’s job offer, and have been here ever since. I am the proud owner of an English bulldog and I enjoy fishing and hiking Oahu’s beautiful island with my husband and young son.

I really enjoy helping our clients achieve a fresh start and hopefully relieve them of some of the stress being in debt can cause while protecting them from creditors and helping them survive the bankruptcy process with their dignity intact.

Blanca Goodman

I’m Blake’s wife of 20 plus years. My job is very exciting – I deal with all our clients’ creditors, collections agencies and attorneys. I process all our client’s bills statements, warnings letters, and law suits. I’m the one who spends one hour or more on the phone finding the accounts or negotiating the best deal I can for our clients.

I’m from Mexico and I came to this country 20 years ago. I speak Spanish, and I would love to learn Japanese and Korean. We have two smart twin girls. One of my greatest enjoyments is to listen to audio self improvement books, and classical music.

I dance Kahiko and Auana hula, and wake up every morning to a Zumba exercise routine.

My purpose is to help our clients find debt freedom as soon possible, between 2 years or less. I do have constant communication with our clients about their case, and I want our clients to feel that I do care deeply from my heart.

Jeff Mulford

Jeff Mulford attended California Western School of Law in San Diego, California on a creative problem solving scholarship. When he first stated practicing in 2010, he represented numerous chapter 7 clients throughout Southern California during the height of the foreclosure crisis. He enjoys practicing bankruptcy law because it provides relief to people going through difficult times and puts them on a fresh start towards a brighter financial future.

Blake Goodman

I received my law degree from George Washington University in Washington, D.C. in 1989 and have been exclusively practicing bankruptcy related law in Texas, New Mexico, and Hawaii ever since. In the past, I was a Certified Public Accountant, receiving my license from the State of Maryland in 1988. Today I am unlicensed, inactive and am not holding myself out as a CPA.

I specialize in providing solutions to a family’s debt burdens and tax problems. To date, I’ve helped over 8,000 individuals and families alleviate their financial setbacks caused by overwhelming debt problems. Our law firm is one of the largest bankruptcy filers in the entire state of Hawaii. I moved to Hawaii in 1999 with Blanca, my wife, who works with me at the office, because we wanted to live in tropical paradise. We now have twin daughters and have found Hawaii to be more than just a pretty place to live. It is the center of the universe for us.
